On Route 514 East (Woodbridge Avenue), proceed to the next traffic light. NJ State Bar Association Municipal Court/DWI section This year as Chair of the Municipal Court Section of the New Jersey State Bar Association, I hope to lead a proactive and eminent group of practitioners in a constant battle to preserve legal rights and opportunities for our clients and attorneys. During the past year, our Section members responded to a variety of challenges, chalking up a number of significant accomplishments aimed to better the lives of our clients. Throughout the year, the Section was working to clarify and modify certain provisions contained in the proposed legislation. One of my goals for the Section is to increase communication between Section members and the governmental authorities that issue regulations and guidelines affecting our clients. I am optimistic that attorneys and clients will continue to have a strong and steady voice advocating before our legislature and the AOC on behalf of their needs. Very truly yours, KENNETH VERCAMMEN ______________________ 3. DWI - Protocol Should be Followed. State v. Kashi, ___ NJ Super. ___ A-3319-01T2 (App. Div. June 5, 2003). Defendant was charged with driving while intoxicated. The municipal court judge found defendant guilty based on the Breathalyzer reading but also found that testimony about defendantıs physical condition did not prove beyond a reasonable doubt he was intoxicated. In a trial de novo, defendant was found guilty on both theories. On appeal, we rejected the Breathalyzer readings as unreliable because the officer did not comply with the proper protocols in administering the test, but affirmed the finding of guilty based on the physical observations.
